BUSINESS LAW 108: NEGLIGENT TORT OUTLINE
NEGLIGENT TORT OUTLINE
The paper must be one to two pages (not including the title and reference pages) and
formatted according to APA style. It must be submitted through Blackboard for grading.
No emailed or hard copy submissions will be accepted. Your submission must either be
in Microsoft Word (.doc) or PDF (.pdf) file format- if it is in the incorrect file format,
credit will not be earned.
Address all of the following parts of this assignment:
1. Prepare a one- to two-page double-spaced outline of your Negligent Tort Analysis
Paper that is due later in the term. You will need to reference the Negligent Tort
Analysis Paper instructions in order to draft your outline.
2. Must include a title page with the following:
a. Title of paper
b. Studentàname
c. Course name and number
d. Instructoràname
e. Date submitted
3. Visit the United States Consumer Product Safety Commission (Links to an
external site.) website. Click on ¥calls. hoose one product that has been
recalled.
4. The outline must contain the following major sections that will exist in the
Negligent Tort Analysis Paper:
a. A description of the product subject to recall, including the recall date,
recall number, and the reason for the recall.
b. An analysis of whether the manufacturer would be liable for negligence if
the product had not been recalled and had caused harm to the consumer.
c. A discussion of the following in relation to the product recall: duty of care,
standard of care, breach of the duty of care, actual causation, proximate
causation, actual injury, and defenses to negligence.
d. An application of a relevant consumer protection statute identified in your
text in conjunction with the product recall that you have identified. You
may need to do additional outside research to find a statute.
5. The outline must be accompanied by a reference page that includes at least 2
scholarly sources in addition to the text (so 3 at a minimum that will be used in
your Negligent Tort Analysis Paper).
